Terms of Service

These Terms of Service ("Terms") govern your use of Buildlogg, our mobile web app and website at buildlogg.com (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, you must not use the Service.

Buildlogg is a job management tool for solo business owners, service providers, and small businesses. It helps you create quotes, track jobs, send messages to customers, and take payments — all from your phone.

1. Definitions

  • "We", "us", "our" means Buildlogg, the provider of the Service.
  • "You", "your" means the person or business that has created an account and uses the Service.
  • "Service" means the Buildlogg mobile web app (accessed at buildlogg.com/app/) and website, including all features, tools, and functionality available through your account.
  • "Content" means all data you create, upload, or enter into the Service — customer records, jobs, quotes, line items, notes, photos, message templates, and payment records.
  • "Customer Data" means personal data about your customers that you enter into the Service (names, phone numbers, addresses, email addresses, job details).
  • "Free Plan" and "Pro Plan" mean the subscription tiers described in Section 8.
  • "Stripe" means Stripe Payments UK Ltd, our third-party payment processor.

2. Who can use the Service

  • Age: You must be at least 16 years old to use Buildlogg. If you're under 18, you must have permission from a parent or guardian.
  • Business use: Buildlogg is designed for business use by business owners and service providers. You must have a legitimate business reason to use the Service.
  • UK residency: The Service is provided for users based in the United Kingdom. If you are outside the UK, these Terms may not apply to you and we may not be able to provide the Service.
  • Accurate information: You must provide accurate information when creating your account — your real name, business name, profession, and contact details.
  • One account per business: You may create one account per business. Do not share your login credentials with others outside your business.
  • Account security: You are responsible for keeping your login credentials secure and for all activity that occurs under your account. If you become aware of any unauthorised use, contact us immediately.
  • Account deletion: You can delete your account at any time from Settings, or by emailing us. Deleting your account removes your data from our servers within 30 days.

3. Acceptable use

You agree to use Buildlogg only for legitimate business purposes. You will not:

  • Use the Service to send spam, unsolicited marketing, or abusive messages to anyone, in violation of the Privacy and Electronic Communications Regulations 2003 (PECR) or any other law.
  • Enter customer data you don't have a lawful basis to store under UK GDPR.
  • Use the Service for anything illegal under UK law.
  • Attempt to reverse-engineer, decompile, disassemble, scrape, or otherwise disrupt the Service or its underlying infrastructure.
  • Share your account credentials, resell access to the Service, or use the Service to provide a competing service.
  • Upload content that is unlawful, defamatory, infringes someone else's intellectual property, or contains malware or other malicious code.
  • Use the Service in a way that could damage, disable, overburden, or impair the Service or interfere with other users' use of the Service.

If we believe you've violated these Terms, we may suspend or terminate your account. We'll give you notice and a chance to fix the issue unless the violation is serious or urgent (e.g. illegal activity or a security threat).

4. Your content and data

4.1 Ownership

"Content" means everything you create in Buildlogg — customer records, jobs, quotes, line items, notes, photos, message templates, and payment records.

  • You own your content. Buildlogg doesn't claim any rights to your business data. We process it solely to provide the Service to you.
  • You are responsible for the accuracy, lawfulness, and quality of the content you enter.
  • We may use aggregate, anonymised data about how the Service is used to improve features — but we will never look at, share, or sell your specific customer data or pricing.

4.2 Your responsibilities as a data controller

When you enter Customer Data (your customers' personal data) into the Service, you are the data controller for that data and Buildlogg acts as your data processor. This means:

  • You must have a lawful basis to collect and store your customers' personal data under UK GDPR Article 6 (typically legitimate interest or contract).
  • You must inform your customers that you're using a third-party tool (Buildlogg) to store their data, and provide them with a privacy notice that covers this.
  • You must respond to your customers' data rights requests (access, erasure, rectification). Buildlogg will assist you where technically possible (e.g. exporting or deleting data).
  • You must not enter data that you don't have a lawful basis to store, or that your customer has asked you to delete.
  • See our Privacy Policy for full details on how we process data as your processor.

4.3 Data backup and sync

Buildlogg is an offline-first app. Your data is stored on your device and syncs to our cloud servers when you have an internet connection. You are responsible for ensuring your data has synced (open the app with signal periodically). We are not liable for data loss caused by device failure if the data had not yet synced to our servers.

4.4 Data Processing Agreement (DPA)

To comply with Article 28 of the UK GDPR, this section serves as our Data Processing Agreement. When processing Customer Data on your behalf, we agree to:

  • Process the personal data only on your documented instructions, unless required to do so by UK law.
  • Ensure that persons authorised to process the personal data have committed themselves to confidentiality.
  • Implement appropriate technical and organisational measures to ensure a level of security appropriate to the risk.
  • Not engage another processor (a sub-processor) without your prior specific or general written authorisation. We currently use Supabase (database hosting), Stripe (payments), and PostHog (analytics) as sub-processors.
  • Assist you, insofar as this is possible, in fulfilling your obligation to respond to requests for exercising the data subject's rights laid down in Chapter III of the UK GDPR.
  • Assist you in ensuring compliance with the obligations pursuant to Articles 32 to 36 of the UK GDPR taking into account the nature of processing and the information available to us.
  • At your choice, delete or return all the personal data to you after the end of the provision of services relating to processing, and delete existing copies unless UK law requires storage of the personal data.
  • Make available to you all information necessary to demonstrate compliance with the obligations laid down in Article 28 of the UK GDPR.

5. Quotes, messages, and communications

5.1 Quotes and messages

Buildlogg lets you send quotes and messages to your customers via WhatsApp, SMS, or text. You are responsible for the content of anything you send. We don't review or approve messages before they're sent — you are the sender, not us.

  • PECR compliance: You must comply with the Privacy and Electronic Communications Regulations 2003 (PECR) when sending marketing messages. Service messages (quotes, booking confirmations, reminders) are not direct marketing and can be sent without prior consent. Marketing messages (promotional offers) require the recipient's consent under PECR Regulation 22.
  • Opt-out: You must include opt-out instructions in any marketing message you send through the Service.
  • No liability for content: We are not liable for the content of messages you send, including any defamatory, inaccurate, or unlawful content.
  • WhatsApp terms: When sending messages via WhatsApp, you must comply with WhatsApp's Terms of Service and applicable messaging policies.

5.2 Online booking page

If you enable the online booking feature, we will create a public booking page at buildlogg.com/book/[your-slug]. You are responsible for the services, prices, and availability you publish on your booking page. We may remove a booking page if it contains unlawful or inappropriate content.

6. Payments and Stripe

6.1 Card payments via Stripe

If you use the card payment feature, payments are processed by Stripe Payments UK Ltd. Buildlogg facilitates the creation of payment links but is not a payment processor or a party to the payment transaction.

  • Stripe terms: By enabling card payments, you agree to Stripe's Terms of Service, Stripe Connect Account Agreement, and Stripe's Privacy Policy. You must complete Stripe's identity verification (KYC) process.
  • PCI-DSS: We do not store card numbers. Stripe handles all card data under their PCI-DSS Level 1 compliance.
  • Payment disputes: Buildlogg is not responsible for payment disputes, chargebacks, or fraud. These are handled between you, your customer, and Stripe under Stripe's dispute resolution process.
  • Fees: Stripe charges transaction fees for card payments. You are responsible for all Stripe fees. Buildlogg does not take a percentage of your payments.
  • Payouts: Stripe transfers funds to your bank account according to Stripe's payout schedule. Buildlogg has no control over payout timing.

6.2 Subscription payments to Buildlogg

If you subscribe to the Pro Plan, your subscription is billed through Stripe. Your subscription renews automatically at the end of each billing period (monthly or annually) until you cancel.

6.3 Buildlogg is Not a Marketplace

Buildlogg provides software tools for independent businesses. We are not a marketplace, directory, or intermediary. Specifically:

  • We do not vet, endorse, or recommend any tradesperson or business using the Service.
  • We are not a party to any contract for services between you and your customers.
  • We bear no liability for the quality of work performed, property damage, delays, disputes, or non-payment arising from jobs managed through our platform.
  • Your customers must direct all queries, complaints, and claims regarding the services provided directly to you.

7. Offline-first nature

Buildlogg stores your data on your device first, then syncs to the cloud when you have an internet connection. This means:

  • If you lose your phone without having synced, some data may not be recoverable. We recommend ensuring the app has synced (open the app with signal periodically).
  • If you uninstall the app, your local data is deleted immediately. Cloud-synced data remains on our servers and can be restored if you reinstall and log in.
  • Because the app works offline, there may be a delay between an action on your device and it appearing in our cloud backup. This is normal and not a service failure.

8. Free and paid plans

Buildlogg offers a Free Plan with core features and a paid Pro Plan with additional features (such as PDF quotes, signature removal, and card payments).

  • Free Plan: The Free Plan has no time limit — you can use it indefinitely. We may limit certain features or add usage caps to the Free Plan with at least 30 days' notice.
  • Pro Plan billing: Paid plans are billed monthly or annually through Stripe. You can cancel at any time from Settings. Cancellation takes effect at the end of your billing period — you keep access until then.
  • Automatic renewal: Your subscription renews automatically unless you cancel before the renewal date. You will be charged the same price unless we've notified you of a price change at least 30 days in advance.
  • Price changes: We may change pricing for new subscribers at any time. For existing subscribers, we'll give at least 30 days' notice before any price increase. If you don't agree with the new price, you can cancel before it takes effect.
  • Refunds: We offer a 14-day money-back guarantee on annual plans. Contact us within 14 days of payment for a full refund. Monthly plans are non-refundable except where required by law.
  • VAT: Prices are inclusive of VAT where applicable. VAT receipts are available on request.

9. Service availability and support

  • No uptime guarantee: We aim for high availability but do not guarantee uninterrupted service. We may perform maintenance, updates, or changes that temporarily affect the Service. We'll try to schedule maintenance outside UK business hours where possible.
  • Offline functionality: Because Buildlogg is offline-first, most features continue working without an internet connection. Cloud sync, card payments, online booking, and email notifications require connectivity.
  • Feature changes: We may add, change, or remove features at any time. We'll give notice of significant changes via email or in-app notification. We will not remove a core feature (quote creation, job tracking, payment recording) without providing an alternative or at least 60 days' notice.
  • Support: You can contact us at hello@buildlogg.com for support. We aim to respond within 2 business days. Support is provided on a reasonable-effort basis and is not governed by a service level agreement.

10. Intellectual property

  • Our IP: Buildlogg, the Buildlogg logo, the Service design, source code, and all related materials are our intellectual property. You may not copy, modify, distribute, or create derivative works from them.
  • Your IP: Your Content remains your intellectual property. We claim no rights to it beyond the limited licence described in Section 4.1 (processing it to provide the Service to you).
  • Trademarks: "Buildlogg" and the Buildlogg logo are our trademarks. You may not use them without our prior written consent, except to refer to the Service accurately (e.g. "I use Buildlogg for my business").
  • Open source: The Service includes open-source software governed by its respective licences. Open-source licences are available on request.
  • Feedback: If you provide us with feedback or suggestions about the Service, we may use them without any obligation to you.

11. Limitation of liability

Buildlogg is provided "as is" and "as available". To the maximum extent permitted by law:

  • We are not liable for indirect or consequential losses — including lost revenue, lost profits, lost data, or business interruption — resulting from use of the Service.
  • We are not liable for the content of quotes or messages you send through the Service.
  • We are not liable for payment disputes, chargebacks, or fraud — these are between you, your customer, and Stripe.
  • We are not liable for data loss on your device that has not synced to our servers (see Section 7).
  • We are not liable for third-party service failures — including WhatsApp outages, SMS delivery failures, Stripe downtime, or Supabase outages.
  • Our total liability for any claim related to the Service is limited to the amount you've paid us in the 12 months before the claim, or £100, whichever is greater.

11.1 Exceptions

The following are not excluded or limited:

  • Our liability for death or personal injury caused by our negligence.
  • Our liability for fraud or fraudulent misrepresentation.
  • Our liability for breach of the obligations implied by Section 12 of the Supply of Goods and Services Act 1982 (care and skill).
  • Any liability that cannot be excluded or limited under UK law.

11.2 Consumer rights

If you are using the Service as a consumer (not as a business), you have statutory rights under the Consumer Rights Act 2015 that cannot be excluded by these Terms. Nothing in these Terms affects those rights. In particular, the Service must be provided with reasonable care and skill, and these Terms do not limit your right to reject the Service if it is not of satisfactory quality.

If you are using the Service as a business, you acknowledge that the limitations and exclusions in this Section 11 are reasonable and fair.

12. Indemnity

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:

  • Your use of the Service in violation of these Terms.
  • Content you create or messages you send through the Service.
  • Your breach of UK GDPR, PECR, or any other data protection law in relation to Customer Data you enter.
  • Your breach of a third party's intellectual property rights.
  • Any claim by one of your customers regarding their personal data.

We will notify you promptly of any claim and may, at our option, conduct the defence. You will not settle any claim without our consent.

13. Termination

  • By you: You can stop using Buildlogg and delete your account at any time from Settings or by emailing us. No notice is required.
  • By us — for cause: We may suspend or terminate your account immediately if you violate these Terms, if your account is used for illegal activity, or if we're legally required to do so.
  • By us — for inactivity: We may terminate your account if it's inactive for more than 12 months. We'll email you at least 30 days before termination.
  • By us — for convenience: We may discontinue the Service or terminate your account with at least 60 days' notice, unless there's a compelling business or legal reason for shorter notice.
  • Effect of termination: On termination, your data is removed from our servers within 30 days. You can export your data before termination by contacting us. Pro Plan subscriptions are non-refundable upon termination for cause (violation of Terms).
  • Survival: Sections 1 (Definitions), 4.1 (Ownership), 11 (Limitation of liability), 12 (Indemnity), and 14 (Governing law) survive termination.

14. Governing law and dispute resolution

14.1 Governing law

These Terms are governed by the laws of England and Wales. Any disputes will be resolved in the courts of England and Wales.

14.2 Consumer dispute resolution

If you are using the Service as a consumer and we cannot resolve a dispute informally, you may use the Online Dispute Resolution platform established by the European Commission (ec.europa.eu/consumers/odr) to submit a complaint. We are not obligated to participate in alternative dispute resolution (ADR) but will consider it in good faith.

14.3 Business users

If you are using the Service as a business, any dispute shall be referred to and finally resolved by arbitration under the Rules of the London Court of International Arbitration (LCIA). The seat of arbitration shall be London, England. The number of arbitrators shall be one. The language of the arbitration shall be English.

15. Force majeure

We are not liable for any failure or delay in performing our obligations under these Terms if the failure or delay is caused by events beyond our reasonable control, including but not limited to: natural disasters, epidemics, government action, war, terrorism, internet or telecommunications failures, power outages, or failures of third-party services (Stripe, Supabase, Cloudflare). We will use reasonable efforts to resume performance as soon as possible.

16. Changes to these Terms

We may update these Terms from time to time. When we make changes:

  • We'll update the "Last updated" date at the top of this page.
  • If the changes are material (i.e. they affect your rights, obligations, or pricing), we'll notify you by email and/or in-app notification at least 30 days before the changes take effect.
  • If you continue to use the Service after the changes take effect, you accept the updated Terms.
  • If you don't agree with material changes, you can cancel your subscription before the changes take effect. If you have an annual subscription, you may be entitled to a pro-rata refund for the unused period.

17. Entire agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Buildlogg regarding the Service. They supersede any prior agreements or understandings, whether written or oral.

If any part of these Terms is found to be unenforceable by a court, the rest of the Terms will remain in full force and effect.

No waiver of any term will be deemed a further or continuing waiver of that or any other term.
